  • Ban all hemp products containing any form of THC or “intoxicating cannabinoids” beyond CBD or CBG.
  • Criminalize possession and sales of products like Delta-8, Delta-9, and even THCA, with penalties ranging from misdemeanors to third-degree felonies.
  • Require $20,000 in annual registration per retail location, and $10,000 per manufacturing site.
  • Demand a $500 fee per individual product, along with strict packaging and labeling regulations.
  • Force retailers to include QR codes linking to lab results and impose specific THC thresholds that effectively eliminate most full-spectrum or minor cannabinoid products.

This bill doesn’t just impact businesses—it impacts patients, adult consumers, veterans, and anyone relying on accessible hemp-based wellness products.

Why It Matters

The Texas hemp industry is largely composed of small, local businesses working hard to operate legally and provide safe alternatives to unregulated street drugs. SB 5 threatens:

Rather than supporting smart regulation, SB 5 aims to eliminate an entire industry under the guise of public safety—all while ignoring the real need for a comprehensive adult-use cannabis policy in Texas.

What’s Next

A public hearing for SB 5 is scheduled for Monday, July 22 at 9 AM in front of the Senate State Affairs Committee at the Texas Capitol in Austin. If the bill passes out of committee, it moves to the full Senate, then the House, and ultimately to Governor Abbott’s desk.

Abbott vetoed a similar bill (HB 3) earlier this year, citing concerns over banning products outright. However, this latest move puts the pressure back on.
